1) Introduction and Contact Details of the Controller

1.1 We are pleased that you are visiting our website and thank you for your interest. Below, we provide you with information about how we handle your personal data when you use our website. Personal data means any information relating to an identified or identifiable individual.

2) Data Collection When Visiting Our Website

2.1 When using our website for information purposes only, i.e. if you do not register or otherwise provide us with information, we only collect data that your browser transmits to the page server (so-called “server log files”). When you access our website, we collect the following data, which is technically necessary for us to display the website to you:

The data will not be disclosed or otherwise used. However, we reserve the right to subsequently review the server log files if there are concrete indications of unlawful use.

2.2 For security reasons and to protect the transmission of personal data and other confidential content (e.g. orders or enquiries to the controller), this website uses SSL or TLS encryption. You can recognise an encrypted connection by the character sequence “https://” and the padlock symbol in your browser’s address bar.

3) Hosting & Content Delivery Network

For the hosting of our website and the presentation of its content, we use a provider that provides its services itself or through selected subcontractors exclusively on servers located within the European Union.

All data collected on our website is processed on these servers.

We have concluded a data processing agreement with the provider which ensures the protection of our website visitors’ data and prohibits unauthorised disclosure to third parties.

4) Cookies

In order to make visiting our website attractive and to enable the use of certain functions, we use cookies, i.e. small text files that are stored on your device. Some of these cookies are automatically deleted after you close your browser (so-called “session cookies”), while others remain on your device for longer and enable the storage of page settings (so-called “persistent cookies”). If your contact is aimed at entering into a contract, the additional legal basis for processing is Art. 6(1)(b) GDPR. Your data will be deleted if it can be inferred from the circumstances that the matter in question has been conclusively clarified and provided that there are no statutory retention obligations to the contrary.

6) Data Processing When Opening a Customer Account

Pursuant to Art. 6(1)(b) GDPR, personal data will continue to be collected and processed to the extent necessary if you provide us with such data when opening a customer account. You can find out which data is required to open an account from the input form provided on our website.

You can delete your customer account at any time by sending a message to the controller at the address stated above. After your customer account has been deleted, your data will be deleted provided that all contracts concluded through the account have been fully processed, there are no statutory retention periods to the contrary, and we have no legitimate interest in retaining the data.

7) Use of Customer Data for Direct Marketing

Advertising by post

On the basis of our legitimate interest in personalised direct marketing, we reserve the right to store your first and last name, postal address and, insofar as we have received this additional information from you as part of the contractual relationship, your title, academic degree, year of birth and professional, industry or business designation pursuant to Art. 6(1)(f) GDPR and to use this information to send you interesting offers and information about our products by post.

You may object to the storage and use of your data for this purpose at any time by contacting us.

8) Data Processing for Contract Processing

8.1 To process the contract, we cooperate with the service provider(s) listed below, who support us in whole or in part in the performance of contracts concluded with you. Certain personal data will be transmitted to these service providers in accordance with the following information.

8.2 Use of Payment Service Providers

One or more online payment methods provided by the following provider are available on this website: PAYONE GmbH, Lyoner Straße 9, 60528 Frankfurt/Main, Germany.

If you select a payment method provided by the above-mentioned provider for which you make an advance payment (e.g. credit card payment), the payment data you provide during the ordering process (including your name, address, bank and payment card details, currency and transaction number) as well as information about the content of your order will be transmitted to the provider pursuant to Art. 6(1)(b) GDPR. In this case, your data will be transmitted exclusively for the purpose of processing the payment with the provider and only to the extent necessary for this purpose.

8.3 In fulfilment of statutory requirements, we collect the following information from foreign nationals and, insofar as tourism or spa charges are levied for your stay, also from domestic guests, prior to the start of your stay: information about your arrival and departure, your first and last name, date of birth, address, nationality, the serial number of your identity document, as well as the first and last names of fellow travellers. This data is collected electronically in order to create digital registration forms.

These registration forms must be presented to the competent registration authority upon request. They must be retained for up to 12 months after the date of departure and destroyed within three months after the end of this retention period.

If tourism or spa charges are levied for your stay on the basis of municipal regulations, the data from the registration form will be transmitted to the competent municipal administration in order to ensure the proper processing and payment of these charges. The municipal administration retains this data for the duration of the statutory tax retention period.

The legal basis for this processing is Art. 6(1)(c) GDPR in conjunction with the applicable registration and, where applicable, municipal regulations. As the controller, we are legally obliged to collect the specified personal data for registration purposes and, where applicable, to forward it to the municipal administration for the purpose of collecting the relevant charges.

9) Website Functions

9.1 YouTube

This website uses plugins to display and play videos provided by the following provider: Google Ireland Limited, Gordon House, 4 Barrow St, Dublin, D04 E5W5, Ireland.

Data may also be transmitted to: Google LLC, USA.

When you access a page of our website containing such a plugin, your browser establishes a direct connection to the provider’s servers at the latest when the video is played in order to load the content. Certain information, including your IP address, is transmitted to the provider in this process.

When playback of embedded videos is started via the plugin, the provider also uses cookies to collect information about user behaviour, compile playback statistics and prevent abusive behaviour.

If you are logged into a user account with the provider while visiting our website, your data will be directly associated with your account when you click on a video. If you do not wish your data to be associated with your account, you must log out before activating the playback button.

All of the processing described above, in particular the setting of cookies for reading information from the device used, only takes place if you have expressly consented to this pursuant to Art. 6(1)(a) GDPR. You may withdraw your consent at any time with effect for the future by deactivating this service via the “Cookie Consent Tool” provided on the website.

For data transfers to the USA, the provider has joined the EU-US Data Privacy Framework, which, based on an adequacy decision by the European Commission, ensures compliance with the European level of data protection.

9.2 Google Maps

This website uses an online map service provided by the following provider: Google Maps (API) from Google Ireland Limited, Gordon House, 4 Barrow St, Dublin, D04 E5W5, Ireland (“Google”).

Google Maps is a web service for displaying interactive (land) maps in order to visually present geographical information. By using this service, our location is shown to you and directions to our location can be facilitated.

When you access subpages on which the Google Maps map is integrated, information about your use of our website (such as your IP address) is transmitted to Google servers and stored there. This may also involve transmission to the servers of Google LLC in the USA. This takes place regardless of whether Google provides a user account through which you are logged in or whether no user account exists. If you are logged in to Google, your data is directly associated with your account. If you do not wish the data to be associated with your profile with Google, you must log out before activating the button. Google stores your data (even for users who are not logged in) as usage profiles and analyses it.

The collection, storage and analysis are carried out pursuant to Art. 6(1)(f) GDPR on the basis of Google’s legitimate interest in displaying personalised advertising, conducting market research and/or designing Google websites according to users’ needs. You have the right to object to the creation of these user profiles, although you must contact Google to exercise this right. If you do not agree to the future transmission of your data to Google in connection with the use of Google Maps, you can also completely deactivate the Google Maps web service by disabling JavaScript in your browser. Google Maps, and therefore the map display on this website, can then no longer be used.

Where legally required, we have obtained your consent pursuant to Art. 6(1)(a) GDPR for the processing of your data described above. You may withdraw your consent at any time with effect for the future. To exercise your right of withdrawal, please follow the procedure described above for exercising your objection.

9.4 Google Customer Reviews (formerly Google Certified Shops Programme)

We work with Google as part of the “Google Customer Reviews” programme. The provider is Google Ireland Limited, Gordon House, 4 Barrow St, Dublin, D04 E5W5, Ireland (“Google”). This programme gives us the opportunity to obtain customer reviews from users of our website. After making a purchase on our website, you will be asked whether you would like to participate in an email survey conducted by Google.

If you give your consent pursuant to Art. 6(1)(a) GDPR, we will transmit your email address to Google. You will receive an email from Google Customer Reviews asking you to rate your experience on our website. The rating you submit will subsequently be combined with our other reviews and displayed in our Google Customer Reviews logo and in our Merchant Center dashboard. Your review will also be used for Google Seller Ratings. As part of the use of Google Customer Reviews, personal data may also be transmitted to the servers of Google LLC in the USA.

You may withdraw your consent at any time by sending a message to the controller responsible for data processing or to Google.

HOWEVER, WE RESERVE THE RIGHT TO CONTINUE processing the data if we can demonstrate compelling legitimate grounds for the processing which override your interests, fundamental rights and freedoms, or if the processing serves the establishment, exercise or defence of legal claims.

11) Storage Period of Personal Data

The duration of the storage of personal data is determined on the basis of the respective legal basis, the purpose of processing and, where applicable, additionally on the basis of the respective statutory retention period (e.g. retention periods under commercial and tax law).

When personal data is processed on the basis of express consent pursuant to Art. 6(1)(a) GDPR, the data concerned will be stored until you withdraw your consent.

If statutory retention periods apply to data processed in the context of legal transactions or legal obligations similar to legal transactions on the basis of Art. 6(1)(b) GDPR, such data will be routinely deleted after expiry of the retention periods, provided that it is no longer required for the performance of the contract or the initiation of a contract and/or we have no legitimate interest in continuing to store the data.

When personal data is processed on the basis of Art. 6(1)(f) GDPR, such data will be stored until you exercise your right to object pursuant to Art. 21(1) GDPR, unless we can demonstrate compelling legitimate grounds for the processing which override your interests, rights and freedoms, or the processing serves the establishment, exercise or defence of legal claims.

When personal data is processed for the purpose of direct marketing on the basis of Art. 6(1)(f) GDPR, such data will be stored until you exercise your right to object pursuant to Art. 21(2) GDPR.

Unless otherwise stated in the other information in this Privacy Policy regarding specific processing situations, stored personal data will otherwise be deleted when it is no longer necessary for the purposes for which it was collected or otherwise processed.
